On April 1, 2010, the Bankruptcy Court entered an order (the "Bar Date Order") setting the deadline for parties to file claims against Atrium. Pursuant to the Bar Date Order, a party seeking to assert a claim against Atrium must complete, sign, and return its Proof of Claim form to GCG on or before June 11, 2010 at 4:00 p.m. (Prevailing Eastern Time) (the "General Bar Date"). For "Governmental Units" (as defined in section 101(27) of the Bankruptcy Code), the deadline to submit a claim against Atrium is July 19, 2010 at 4:00 p.m. (Eastern Time) (the "Governmental Bar Date"). For creditors that appear on Atrium's Chapter 11 Schedules of Assets and Liabilities, the Proof of Claim form will set forth the scheduled amount in the top right corner, and the Proof of Claim need only be returned if a creditor disagrees with the amount listed, the categorization of their claim, or if their claim is listed as contingent, unliquidated and/or disputed.
On April 28, 2010, the Bankruptcy Court entered an Order Confirming the Debtors' Second Modified Joint Plan of Reorganization (the "Confirmation Order"). As such, all requests for payment of an Administrative Claim must be filed with the Bankruptcy Court and served upon the Reorganized Debtors on or before May 30, 2010, which is the date that is thirty (30) days after the Effective Date of April 30, 2010.
